PROPERTY DESCRIPTION
NOTE: Tracts 4 and 5 may be combined and bid on together.
TRACT DESCRIPTIONS
Tract 1: 3.2± ac Wonderful country homestead that includes large 2 story home built in 1906. Original oak woodwork and doors. Many mature trees along with well maintained barn and machine shed. Perfect opportunity for 4-H or family projects.
Tract 2: 29.4± ac Excellent farm land, all tillable, consisting mainly of Crosier and Brookston Loam soils.
Tract 3: 16.8± ac Wooded tract with wonderful hunting and recreation opportunities. Has 50 ft. frontage and access from CR 32. Any home construction on this tract would need to be approved by the Elkhart County Planning Board.
Tract 4: 27.9± ac Swing Tract Excellent tillable farm land consisting mostly of Crosier and Brookston soils. This tract must be bid in combination with a tract/tracts providing road frontage or by an adjoining land owner.
Tract 5: 2.4± ac Swing Tract Tillable land with frontage on CR 32. Due to the size of this tract, it must be purchased in combination with an adjoining tract or by an adjoining landowner.
SOIL INFORMATION
PROCEDURE: The property will be offered in 5 individual tracts, any combination of tracts and as a total 80 acres. There will be open bidding on all tracts and combinations during the auction as determined by the Auctioneer. Bids on tracts, tract combinations and the total property may compete.
DOWN PAYMENT: 10% of the accepted bid price as down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashiers check, personal check, or corporate check. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, SO BE SURE YOU HAVE ARRANGED FINANCING, IF NEEDED, AND ARE CAPABLE OF PAYING CASH AT CLOSING.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements at the auction site immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection.
EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price.
DEED: Seller shall provide Warranty Deed(s). Real estate sold subject to all rights of way, legal highways, leases and easements of public road.
CLOSING: The balance of the purchase price is due at closing, which will take place 30 days after the auction or as soon thereafter as applicable closing documents are completed. Closing costs shall be split 50/50 between Buyer(s) and Seller. All lender costs shall be paid by the Buyer(s).
POSSESSION: Possession is at closing, subject to farm tenants rights through December 31, 2011.
REAL ESTATE TAXES: Seller shall pay 2011 taxes due in 2012. Buyer shall assume taxes for the 2012 calendar year.
ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. Combination purchases will receive a perimeter survey only. Final sales price shall be adjusted to reflect any difference between advertised and surveyed acres.
PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel. Further, Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property.
EASEMENTS: Subject to any and all existing easements.
AGENCY: Schrader Real Estate & Auction Company, Inc. and its representatives are exclusive agents of the Seller.
